- Your purchase gives you a personal license to use the files for your own family's caregiving. Please don't resell or share them publicly.
- Our products help you organize. They aren't medical, legal, tax or financial advice.
1. Who we are and these terms
Care Desk HQ ("we", "us", "our") is operated by Creative Media Commerce, [business address]. These Terms of Service ("Terms") apply to your use of caredeskhq.com (the "Site") and any products you buy or download from us (the "Products").
By using the Site or buying or downloading a Product, you agree to these Terms and to our Privacy Policy and Refund Policy. If you don't agree, please don't use the Site or Products.
2. Eligibility
You must be at least 18 years old, or the age of majority where you live, to buy from us. By placing an order you confirm that the information you provide is accurate and that you're authorized to use your payment method.
3. Products and delivery
Our Products are digital files, such as printable PDFs and spreadsheets for Google Sheets or Microsoft Excel. Nothing is shipped. After payment, you'll get download access on the confirmation page and by email.
You're responsible for having a device and software that can open the files (for example, a PDF reader and Google Sheets or Excel). Please download and save your files promptly; download links may expire.
We work to describe Products accurately, but we may correct errors, update content, or change or discontinue Products at any time.
4. Your license to use the Products
When you buy a Product, we grant you a limited, non-exclusive, non-transferable license to download, print and use it for personal, non-commercial use. That includes sharing copies with family members, friends and paid caregivers who help care for the same person, for example sharing the dashboard with your siblings.
You may not:
- Resell, sublicense, give away or distribute the Products or any part of them
- Post the files, or substantial parts of them, on a website, social media, file-sharing service or marketplace
- Use the Products in a paid service, course, workshop or business without our written permission
- Remove copyright notices or claim the Products as your own
If you'd like to use our materials with clients, employees or an organization, ask us about a professional license.
5. Prices and payment
Prices are shown in U.S. dollars and may change at any time. A price change won't affect an order you've already placed. Payments are processed by our e-commerce platform and its payment partners; we don't store your full card number. You're responsible for any taxes that apply to your purchase.
We may refuse or cancel an order, for example if a product was listed at the wrong price or we suspect fraud. If we cancel a paid order, we'll refund you in full.
6. Refunds
Because our Products are delivered instantly as downloads, sales are generally final. Our Refund Policy explains when we will replace a file or refund you.
7. Not professional advice
Our Products and Site content are for general information and organizing only. They are not medical, legal, tax, financial or insurance advice, and they don't create a professional or client relationship. Laws, forms and benefit rules (including Medicare) vary by state and change over time.
Always follow the guidance of your parent's doctors and care team, and talk with a qualified professional, such as an elder law attorney, financial professional or tax advisor, before making decisions. In an emergency, call 911.
8. Information you enter in the Products
Information you type or write into our worksheets and spreadsheets stays in your own files and accounts; we don't receive it. You're responsible for keeping those files secure and for choosing who you share them with. Our Products remind you never to record passwords, full account numbers or ID numbers, and we encourage you to follow that advice.
9. Intellectual property
The Site and Products, including text, designs, worksheets, the Care Desk HQ name and logo, and names such as the 4-Drawer Method, are owned by Creative Media Commerce and protected by copyright, trademark and other laws. Except for the license in section 4, no rights are granted to you.
10. Using the Site
Please don't misuse the Site. That includes trying to get unauthorized access, interfering with its operation, scraping it in bulk for commercial purposes, or using it to break the law. We may suspend access for anyone who does.
The Site may link to other websites. We aren't responsible for their content or practices.
11. Disclaimer of warranties
To the fullest extent allowed by law, the Site and Products are provided "as is" and "as available", without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We don't promise that the Products will meet every need, achieve any particular result, or be error-free.
12. Limitation of liability
To the fullest extent allowed by law, Creative Media Commerce and its owners, employees and partners will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, income or opportunity, arising from your use of the Site or Products. Our total liability for any claim relating to the Site or Products is limited to the amount you paid us for the Product involved.
Some places don't allow these limits, so they may not all apply to you.
13. Indemnity
You agree to defend and hold harmless Creative Media Commerce from claims, losses and costs (including reasonable legal fees) that arise from your misuse of the Products or Site or your violation of these Terms.
14. Governing law and disputes
These Terms are governed by the laws of the State of [STATE], without regard to its conflict-of-law rules. Any dispute will be handled in the state or federal courts located in [COUNTY, STATE], unless the law where you live requires otherwise. Before filing any claim, please contact us so we can try to resolve it informally.
15. Changes to these Terms
